Are Toy Guns Protected by the Second Amendment?

This is a real stretch by the ATF. Apparently the ATF has decided to go after toy guns because they have no protection under the Second Amendment. Seizing Airsoft pellet guns because they might easily be converted into a "Machine Gun". What planet are these guys from and what do they really know about firearms. I suspect many are just young kids out of college who never handled a gun until they joined the ATF. I owe several Airsoft guns and the metal they are made of would not with stand more than several rounds of real ammo before the barrel melted down of just exploded. I don't know the caliber of these guns, but most AirSoft guns are .177cal and a few are .22cal. Some Airsoft guns are fully automatic, but the barrel doesn't heat during rapid fire, in fact just the opposite occurs since the pellet guns use CO2 gas and when firing the barrels get colder. I suspect these guys had little else to do and targeted a toy that looked menacing. Just another effort by Obama's Justice Department to make inroads on guns rights because they are having little luck in the federal court system. Yes, now Eric Holder and Barack Hussein can crow to their left base and boast about taking danger "Machine Guns" off the streets of America, while leaving out the fact they were air guns, but then liberal don't know the difference. To them a gun is a gun!
Feds Seize Toys, Call Them 'Machine Guns'
A gun rights organization has launched a Freedom of Information request following a decision by federal Customs and Border Protection agents to seize a shipment of toy pellet guns and a determination by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives that they could be converted into machine guns so they must be destroyed.

Government agencies have explained that the Airsoft toys, made of a soft pot metal and lacking a firing mechanism, easily could be converted into a true weapon capable of automatic fire.

"Our firearms technology branch classified this as a machine gun," BATFE Special Agent Kelvin Crenshaw said in a report assembled by Gun Owners of America. "With minimal work it could be converted to a machine gun."

Gun Owners spokesman Erich Pratt told WND today his organization has launched a FOIA demand for information to find out on what basis the government reached that conclusion.

The case stems from the confiscation just weeks ago of the shipment of several dozen of the plastic pellet-firing Airsoft toys from Brad Martin and his son, Ben, in Cornelius, Ore. Source: Fox Nation

Our Second Amendment Rights

Today while visiting two of my favorite blogs today Right Truth and Texas Fred I came across two post that reminded me of what a great country we live in. The first at "Texas Freds" was a reminder of the existing gun rights and how recently many states have reaffirmed the rights granted under the Constitution and the second by Debbie at "Right Truth" was a less obvious reminder of our rights. In her post she relates waking up today to the sound of gunfire. She lives in a rural area and the shots were hunters after the ducks and geese along the Tennessee River. I made the following short comment on her blog and I will pass it along: "I miss the sound of early morning gunfire on the farm, mine most of all. They are a symbol of our rights as Americans. Many other so-called progressive countries are silent and that silence is deafening, and speaks with the voice of authoritarianism. We are blessed".

Radical Muslim Hails Fort Hood Massacre

In someways America seems to becoming a breeding ground for Islamic radicals. With the shooting of an American soldier in Little Rock just as few months ago and now the shootings at Fort Hood being just two examples of whats becoming a larger problems. A New York City cabbie is now openly promoting radical Islam on the Internet and using his second amendment rights to spew his hate. An amendment that his kind would immediately repeal if they had their way. Yousef al-Khattabe, a former Jew who has converted to Islam sent an email to Nidal Malik Hasan claiming the soldiers killed in the massacre deserved what they got and are now in an eternal hellfire. Our Constitution does guarantee freedom of speech and we in the blogging community will fight for that right to always be upheld as we value all our precious freedoms. And although I deplore the words of Yousef al-Khattab under of Constitution he has the right to say them. But I would urge authorities to keep a close eye on this radical and on those who visit his site. For now he is within his rights, but he is pushing those rights to the edges and should he cross the line the government should step in. Islamic radicalism must be restrained and defeated where every it raises it ugly head. We are in a state of war against these people and wartime measures should be imposed. If some way to constitutionally restrict the efforts of those such as Yousef al-Khattable can be found I will support those measures. One additional note on cases such as this, if we were officially at war, in other words a declared war then under the Constitution the President as command-in-chief could take extreme measures and people such as Yousef could be detained and prevented from what is clearly giving "aid and comfort" to the enemy. Sadly our current president would never take such measures. We all know where this weak, Muslim-lover , son and grandson of probable Kenyan Mau Mau terrorist stands. Most do not know or will not admit he has his roots in a nation born from terrorism. Terrorism that directed its attacks not at grown men, but rather at women and children in the dead of night, hacking their victim's to death with machetes as they blew whistles hanging from their necks. This is the beastly revolution that is Obama's heritage and not the American Revolution. Does he hate Islamic terrorist, I think not. He merely sees them as so kind of freedom fighters. And like all good socialist the "end always justifies the means". In other words anything goes!!!!


A New York City bicycle cabbie who mocked the murder of American journalist Daniel Pearl and posted a prayer on the Web calling for the murder of Jews is now sending a "Get Well Soon" message to the suspected Fort Hood gunman, the New York Post reported.

Yousef al-Khattab, 41, a radical Muslim in the borough of Queens who runs RevolutionMuslim.com, claims on the site that the soldiers massacred at the Texas base deserved to be massacred, and he insists the victims are in "eternal hellfire." As for the suspected gunman — Army psychiatrist Maj. Nidal Malik Hasan — Al-Khattab hails him as a hero.

"An officer and a gentleman was injured while partaking in a pre-emptive attack," al-Khattab wrote on the site. "Get well soon Major Nidal. We love you."

Al-Khattab, a Jewish-born New Jersey native formerly named Joseph Cohen, converted to Islam in 2004. Known by the FBI for posting radical messages online, al-Khattab claims that the 13 murdered and 38 wounded soldiers at Fort Hood were "terrorists" who deserved to die.

"These people are soldiers in a volunteer army," al-Khattab told the Post. "They expect to see combat. They know the danger."

"Rest assured the slain terrorists at Ft. Hood are in the eternal hellfire," al-Khattab writes online.

On Oct. 7, al-Khattab posted a message on the Web calling on Allah to carry out "wrath on the Jewish occupiers of Palestine & their supporters."

"Please throw liquid drain cleaner in their faces," he wrote. " … burn their flammable sukkos while they sleep … Ya Allah (Oh God) answer my duaa (prayer)." ("Sukkos" refers to the Jewish holiday of Sukkot, during which Jews build and eat their meals in outdoor huts known as "sukkahs," which represent the huts the Jews lived in during their exodus from Egypt.)

Al Khattab insists that his hatred is protected by the First Amendment. "If it was a threat, I'd be in jail," the 41-year-old al-Khattab told FoxNews.com in October.

Hasan — a radical Muslim — reportedly shouted "Allahu akbar," or "God is great" in Arabic, before unloading more than 100 rounds at soldiers preparing to ship off to Iraq and Afghanistan. read more

Second Amendment

When I was eleven years old I purchased my first gun through the Sears catalog, a .22caliber rifle. I loved that rifle and my family was happy for me. The topic of discussion at most family gatherings normally involved whatever species of animal were in season or gun control. Growing up in this environment has given me an interesting outlook on certain issues, mostly those having to do with gun control and the Second Amendment. It is my belief that the original intent and purpose of the Second Amendment was to preserve and guarantee, not grant the pre-existing right of individuals, to keep and bear arms. The Second Amendment reads: A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

"And any statute or regulation that burdens the right to keep and bear arms on the ground that guns are a public health hazard should enjoy the same frosty reception in court that would be given to a statute or regulation that burdened the free exercise of religion as a mental health hazard. Such an individual right was a legacy of the English Bill of Rights. (Joyce Lee Malcompg79) When, as William Blackstone phrased it in 1803, "the sanctions of society and laws are found insufficient to restrain the violence of oppression". As with any civil right, the essence of persuasion should remain with the proponent of legislation that restricts or burdens the right to keep and bear arms, rather than, as with ordinary legislation, on the opponent. The House committee eliminated the stipulation that the militia be "well-armed," and the Senate, in what became the final version of the amendment, eliminated any description of a militia. Polsby states, the public policy of discouraging people from owning or using firearms is not, by itself, constitutionally permissible , any more than discouraging people from religious observance would be permissible to some future,oh-so-progressive government that considered religion as hopelessly taboo. The use of the word people in the Second Amendment indicates an individual right. With this wording the writers of the constitution have clearly, distinguished between the rights, states and the people. As some consider the right to keep and bear arms. As was the case in the English tradition, the arms in the hands of the people, not the militia, are relied upon"to restrain the violence of oppression". It did not change the amendments guarantee that the right of the people to have arms not be infringed. While the Tenth Amendment which reads: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
